Hoofine Shop terms and conditions

The terms for orders in the Hoofine Shop: who you buy from, how the purchase is made, delivery, withdrawal and warranty.

Last updated: 2026-10-16

⁦§ 1⁩ Scope, contracting party

  1. ⁦(1)⁩

These terms and conditions ("shop terms") apply to every order of goods in the Hoofine Shop at shop.hoofine.com and in the Hoofine app. The seller and your contracting party is Growvit GmbH, Hinterm Stern 24, 22041 Hamburg, Germany, registered with the commercial register of the Amtsgericht Hamburg under HRB 191424, VAT ID DE364892270 ("we", "us").

  2. ⁦(2)⁩

The shop is open to consumers (§ 13 BGB) and businesses (§ 14 BGB). Provisions that apply to only one of these groups say so.

  3. ⁦(3)⁩

The rest of the Hoofine platform, in particular buying and selling horses between members, is governed by the platform's terms and conditions. For an order in the shop, these shop terms take precedence.

  4. ⁦(4)⁩

A customer's own differing terms apply only if we have expressly agreed to them in text form.

⁦§ 2⁩ Conclusion of contract, ordering steps, contract text

  1. ⁦(1)⁩

The presentation of goods in the shop is not a legally binding offer but an invitation to order.

  2. ⁦(2)⁩

    Ordering takes these steps:

    1. ⁦a.⁩You add the goods you want to your cart.
    2. ⁦b.⁩You sign in with your Hoofine account or create one.
    3. ⁦c.⁩You choose or enter a delivery address and, if needed, a different billing address; shipping costs and the estimated delivery time are shown.
    4. ⁦d.⁩In the cart you check the goods, quantities, prices, shipping costs and total, and can change any of them or remove goods up to this point.
    5. ⁦e.⁩By clicking "Buy now" you place a binding order and are taken to our payment provider Stripe to pay.
  3. ⁦(3)⁩

The purchase contract is concluded when payment has been completed successfully; we confirm it by email without delay (order confirmation). If you abandon payment or the payment fails, no contract is concluded.

  4. ⁦(4)⁩

You can correct input errors at any time before submitting the order, in the cart and on the payment page, by changing quantities, removing goods, choosing another address, or cancelling payment and returning to the cart.

  5. ⁦(5)⁩

We store the contract text. You can see your order details under "Orders" in your account; we send you these shop terms and the withdrawal instructions with the order confirmation email. The current version of the shop terms is available at shop.hoofine.com/terms.

  6. ⁦(6)⁩

The contract can be concluded in German or English. If the German version of these shop terms and a translation differ, the German version prevails.

⁦§ 3⁩ Prices, shipping costs, duties

  1. ⁦(1)⁩

All prices are final prices and include statutory VAT. Shipping costs, shown in the cart before you order, are added.

  2. ⁦(2)⁩

Our prices are in euros. Where the shop shows amounts in another currency, this is a non-binding conversion for information; the amount in euros is charged. Any currency conversion fees charged by your card issuer are borne by the customer.

  3. ⁦(3)⁩

For deliveries to countries outside the European Union (such as Switzerland, the United Kingdom, the United States or Canada), customs duties, import VAT and carrier fees may apply. They are not included in the price and are borne by the customer unless the order process expressly states otherwise.

⁦§ 4⁩ Payment

  1. ⁦(1)⁩

Payment is made through the payment provider Stripe, using the payment methods shown during checkout, such as credit or debit card, Apple Pay or Google Pay.

  2. ⁦(2)⁩

The purchase price is due immediately when you order and is charged when payment is completed.

⁦§ 5⁩ Delivery, split shipments, unavailability

  1. ⁦(1)⁩

We deliver to the countries listed under "Shipping" in the shop, to the delivery address you give. Goods are shipped directly to you by our suppliers and fulfilment partners, in part from warehouses outside the European Union.

  2. ⁦(2)⁩

The delivery time is shown with the product and in the cart and starts when payment is received. Times given as "usually" or as a range are estimates.

  3. ⁦(3)⁩

If you order several items, they may arrive in separate parcels. This costs you no extra shipping.

  4. ⁦(4)⁩

If an ordered item cannot be delivered after the contract is concluded through no fault of ours, because our supplier does not supply us despite a corresponding order, we will tell you without delay. We may then withdraw from the contract for that item and will refund any amount already paid for it without delay. Your statutory rights remain unaffected.

  5. ⁦(5)⁩

For consumers, the risk of accidental loss or deterioration of the goods passes only when the goods are handed over to the customer. For businesses, it passes when the goods are handed to the carrier.

⁦§ 6⁩ Retention of title

  1. The goods remain our property until paid in full.

⁦§ 7⁩ Right of withdrawal for consumers

  1. ⁦(1)⁩

Consumers have a statutory right of withdrawal as set out in the following withdrawal instructions. Businesses have no right of withdrawal.

  2. ⁦(2)⁩

There is no right of withdrawal, or it expires early, for contracts

    1. ⁦a.⁩for the supply of goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive, or that are clearly tailored to the consumer's personal needs;
    2. ⁦b.⁩for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery.

Withdrawal instructions

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and indicated by you, take possession of the goods. In the case of a contract for several goods ordered in one order and delivered separately, the period starts on the day on which you, or a third party other than the carrier and indicated by you, take possession of the last item.

To exercise your right of withdrawal, you must inform us (Growvit GmbH, Hinterm Stern 24, 22041 Hamburg, Germany, email: [email protected], phone: +49 172 1336888) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory. You can also electronically fill in and submit the model withdrawal form or any other unequivocal statement on our website (hoofine.com/withdraw-contract). If you use this option, we will communicate to you an acknowledgement of receipt of such a withdrawal on a durable medium (e.g. by email) without delay.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us (Growvit GmbH, Hinterm Stern 24, 22041 Hamburg, Germany) without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

⁦§ 8⁩ Voluntary 30-day returns

  1. ⁦(1)⁩

In addition to the statutory right of withdrawal, we give you a voluntary contractual right to return goods within 30 days of receipt. It does not apply to the goods listed in § 7 (2).

  2. ⁦(2)⁩

A return requires the goods to be unused, complete and ideally in their original packaging. Tell us about the return first, with your order number; we will then give you the return address. You bear the direct cost of returning the goods, unless they are faulty or not what you ordered. We refund the purchase price to your original payment method once the goods have arrived.

  3. ⁦(3)⁩

The voluntary returns right does not limit your statutory right of withdrawal or your statutory warranty rights.

⁦§ 9⁩ Warranty

  1. ⁦(1)⁩

The statutory warranty rights apply. For consumers, claims for defects become time-barred two years after delivery of the goods.

  2. ⁦(2)⁩

For businesses, claims for defects become time-barred one year after delivery; this does not apply to damages claims under § 10 or in case of fraudulent intent. § 377 HGB remains unaffected.

  3. ⁦(3)⁩

If goods arrive with obvious transport damage, please report it to us as soon as you can, with photos if possible. If you are a consumer and do not, this has no effect on your statutory rights.

⁦§ 10⁩ Liability

  1. ⁦(1)⁩

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and to the extent of any guarantee we have given.

  2. ⁦(2)⁩

For a slightly negligent breach of an essential contractual obligation, one whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely, our liability is limited to the foreseeable damage typical for the contract.

  3. ⁦(3)⁩

Otherwise, liability for slightly negligent breaches is excluded. These limitations also apply in favour of our legal representatives and agents.

⁦§ 11⁩ Dispute resolution

  1. ⁦(1)⁩

The European Commission's online dispute resolution platform was discontinued on 20 July 2025.

  2. ⁦(2)⁩

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. For questions or complaints, contact us at [email protected].

⁦§ 12⁩ Final provisions

  1. ⁦(1)⁩

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country in which they have their habitual residence.

  2. ⁦(2)⁩

If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from the contract is Hamburg.

  3. ⁦(3)⁩

If individual provisions of these shop terms are invalid, the rest of the contract remains valid; the statutory provisions take the place of the invalid provision.
